Dish Network v. Stafford/Kocken
(Infinity Systems/Kocken Technologies)

RULE 26( f ) REPORT

In its Order of June 15, 2010, this Court scheduled a Rule 16 conference on July 27, 2010. The Order also called for the parties to jointly confer by July 16, 2010, and file a single joint report by no later than July 21, 2010. the Plaintiffs have reached a settlement, or they are in the process of executing settlement documentation, with Defendants Kelly Stafford, Infinity Systems, LLC, Infinity Systems USA, LLC, and Gerald "Jerry" Pahl.

The Defendants Frank Kocken, Cory Kocken, and Kochen Technologies, L.L.C. have breached this Court's Order and violated their obligations pursuant to Federal Rule of Civil Procedure 26(f) in that they have failed to confer and to create a single joint report to the Court.

The Plaintiffs have this day filed a motion for sanctions against Frank Kocken, Cory Kocken, and/or their counsel. The Plaintiffs have also filed this day a request for default against Kocken Technologies, L.L.C. (Doc 55)




Stipulation in Support of Plaintiffs' Motion for Stipulated Judgment Against
Defendants Kelly Stafford, Infinity Systems USA, LLC and Infinity Systems, LLC

The Plaintiffs and the Defendants, Kelly Stafford, Infinity Systems USA, L.L.C. and Infinity Systems, L.L.C. (hereinafter collectively referred to as the "Stafford Defendants") all assent to the Plaintiffs' Motion for Entry of Judgment against the Stafford Defendants, and they all stipulate and agree:

That judgment may enter against the Stafford Defendants, jointly and severally, pursuant to Title 47 U.S.C. | 605( e ) ( 3 ) and pursuant to Count III of the Plaintiffs' Complaint for the Stafford Defendants' violation of 7 U.S.C. | 605( e ) ( 4 ) in the amount of $250,000. (Doc 48)
