Battles: Make DISH Pay? Viacom Suits Up


In the DISH v. FOX fight, Attorney General Chris Koster of Missouri wants DISH to pay refunds to customers deprived of the FOX programming. Says DISH ... hey! They pulled the channels off! And anyway, "If anyone owes our customers a refund, it’s FOX – and not just for service fees but for the inconvenience of denying our Missouri customers access to the undefeated Mizzou Tigers."

As for the FOX/Cablevision fight, don't look for the government to weigh in on the dispute, say analysts at Stifel Nicolaus. But the fight could put pressure on OTT conditions for the Comcast/NBC-U deal. And mid-term Republican wins will likely to protect broadcasters. (Making us wonder when the not-exactly-liberal cable guys are gonna get more clout ... but hey.)

On to another front ... Smarting from its "safe harbor" loss to Google's YouTube earlier this year, Viacom is upping the ante. Says THR, the Redstone crew has hired Theodore Olson (who won the big Bush v. Gore case, arguably sparking two wars and a near depression) to its team.
